What about your trade mark?
So in your situation and before you begin the process, there is a preliminary check that you must do if you plan to set up and register your brand for a trade mark. We shall examine the fundamental prerequisites for submitting an application to the UKIPO in this article.
The Trade Marks Act of 1994’s section 32(2) lays out the prerequisites for filing. A filing date against the Mark might be issued once all the requirements have been satisfied.
Request for Trade Mark Registration.
Usually, by way of a TM3 form. This can be handled by a private citizen or by one of our legal representatives. It is advisable to obtain legal counsel prior to submitting your TM3, as it is frequently not possible to make changes to the application after it has been submitted. You don’t want to file your Mark only to find out later that you aren’t protected enough!
Your name and address
The application must be completed by the person who will become the proprietor. The applicant’s name may belong to a business or an individual.
A list of the products and services
Making sure the products and services you register your mark under are accurate is arguably one of the most crucial application processes. The applicant must submit a list of the products and services they offer that comply with UKIPO regulations. The class terms can be used in conjunction with the assigned number for each class. If terms you choose are difficult to understand, the examiner may ask you to define them. While this is a less expensive option to avoid completing two applications, you must make sure that you use the necessary words to cover your Mark both now and in the future. We would suggest that your legal representative, like us, complete this stage to make sure no errors are made and your application is properly covered.
Portrayal of the Mark.
This is possibly one of the simplest steps if you have reached this point. In order to file, you must provide a depiction of your Mark. Make sure the Mark is readable and clear.
Please do not hesitate to contact the Tr if you have any questions or need help completing your application.
