As with any brand, there are many competitors out there. If you have a registered trade mark, then you have the power to oppose anyone applying with a similar or identical mark to that of your own.
A recent case has arisen between Oatly and a private farm, selling their brand Pure Oaty.
It has been reported that Oatly have requested that Pure Oaty change their packaging and name of their brand. Pure Oaty have been running for 18 months producing their product from British farmed oats.
In contrast, Oatly was founded in the 1990s and is know as one of the top oat milk suppliers in the UK. The brand has been backed up by celebrities like Jay Z and Natalie Portman.
It is now down to the courts to assess the similarity of these marks and whether there exists a likelihood of confusion. A follow up on this case will be written in the coming weeks, so keep an eye out on our blog posts.
