Lidl v Tesco trade mark logo war: success for Lidl!

The battle of the supermarkets has reached a conclusion and a winner has been found in the trade mark dispute- for now!

Budget supermarket Lidl filed a claim against Tesco over their ‘clubcard’ logo. Lidl claimed that the yellow circle in blue square design used by Tesco to advertise their clubcard deals was too similar to their own logo and was taking advantage of their reputation.

The High Court considered the claim this week and sided with Lidl.

The Judge ruled that Tesco has taken unfair advantage of Lidl’s reputation as a budget supermarket by using the similar logo for its discounts.

After the ruling, a Lidl spokesperson said: “We are pleased that the court has agreed with us and that it will now order Tesco to stop using the Clubcard logo.”

Tesco has announced that it is planning on appealing the decision, with a spokesperson described the matter as being “just about the colour and shape of the Clubcard Prices logo”.

“It has no impact on our Clubcard Prices scheme which we will continue to run in exactly the same way,” the spokesperson said.
